By using the System and/or Site you the User agree to be bound by the terms of this Agreement 3. If you do not agree with all of these Terms and Conditions, do not access or otherwise use this Site or our Service.

All content shall remain the sole and exclusive property of ABNDirect or its licensors. User acknowledges and agrees that it shall not acquire any rights, title or interest in or to any of ABNDirect intellectual property rights.

 

No wording or any other content contained within this site shall be construed as, or intends to grant, any implied rights to any individual, and thus you may not exploit/use any trade mark, patent, trade secret, copyright or other intellectual property contained within the site or the content therein.

 

3. Your rights and obligations:

 

1. We give permission for you to view, download and/or print any Content that we have expressly permitted may be printed or downloaded on your personal computer for your personal use.

 

You agree you will not:

 

i. alter or remove any content appearing on this Site;

 

ii. modify or edit the Content or publish or sell the Content , nor will you make any of the Content available on any other website;

 

iii. without our prior written consent you will not create any links from any other website to this Site

1. We do not give any advice as to the appropriateness or suitability of the Service for you. Please contact the Australian Taxation Office (ATO) or your accountant if you are unsure whether you require an ABN.

 

2. Although our team includes chartered accountants, registered tax agents and business start-up professionals, we do not provide any accounting, financial or legal services or advice as part of this Service.

 

3. Expert Tax & Financial Services Pty Ltd ABN 41 604 978 010 (Registered Tax Agent)  of 19 Market Street, COHUNA VIC 3568 will not be liable for any damages or other charges that arise as a result of any incorrect information provided by you.

 

4. This main aim of this Site is to provide you with a sufficient amount of clear and concise information. However, if you misinterpret such information, we are not liable in any way for any such misinterpretation. Please contact us if there is anything that requires clarification. 

 

5. By electing to utilise our online ABN registration application, you guarantee that the information you supply is accurate and complete, to the best of your knowledge. 

 

6. You authorise us ABNDirect a division of Expert Tax & Financial Services Pty Ltd (Registered Tax Agent) for the purpose of acting as a registered tax agent on your behalf, to act on your behalf throughout the application process for an ABN. We endeavour to start processing your application for ABN registration as soon as it has been submitted.

 

7. Expert Tax & Financial Services Pty Ltd will maintain communications on your behalf with the Australian Tax Office (ATO) using both electronic and telephone communications to expedite your application process.

 

8. Should we be unable to arrange for your ABN registration application to be processed by the ATO immediately through our electronic system, the ATO stipulates we are required to wait 28 day from the date of the application lodgement, before we can contact them to resolve any issues. Only a small number of clients encounter this issue and this should not be cause for concern, as it is quite normal for a small percentage of electronic applications to be rejected by the ATO initially.

 

9. In the event your application is rejected by the ATO it could be due to any number of reasons. These could include, but are not limited to:

 

i. the information you supplied is not an identical match to the information held on record by the ATO; or

 

ii. you have previously had and ABN, currently have an ABN; or have applied for an ABN in the past; or

 

iii. the ATO is experiencing system downtime, maintenance or processing issues, 

 

10. Expert Tax Financial & Services Pty Ltd ABN 41 604 978 010 (Registered Tax Agent)  of 19 Market Street, COHUNA VIC 3568 will contact the ATO on your behalf and attempt to resolve any application related issues should your application be rejected by the ATO and address any issues that may have arisen. We will inform you of the circumstances that led to the rejection and offer possible solutions.

 

11. Expert Tax Financial & Services Pty Ltd ABN 41 604 978 010 (Registered Tax Agent)  of 19 Market Street, COHUNA VIC 3568will issue an Tax Invoice to a client for processing and lodging ABN and GST registration forms with the Australian Taxation Office through www.abndirect.com.au website.

 

12. To all extents permitted by law, we will not extend any refund in connection with our service other than;

 

i. in accordance with the terms of our money-back guarantee.

 

ii. if you notify us in writing that you no longer wish for us to submit an application on your behalf before we, or our agents, have commenced the process of registering your ABN. We may give you a full refund (minus a processing, administration, handling and posting fee of $25). Any refund is issued under our sole and is not obligatory.

6. Third Party Sites

 

Websites which we link to on this Site are not necessarily controlled or maintained by us. To the maximum extent permitted by law, when we provide links to third party websites we do so for your convenience and shall not be responsible for the content contained on any third part sites. We do not recommend or endorse any products, services or materials featured or offered on any third party websites which may be linked to on our Site.

  

7. Liability


1. Subject to any implied condition, warranty or right which cannot be excluded by law:

 

i. we give no warranties, and you have no other rights, apart from those (if any) expressly set out in these Terms; and

 

ii. all implied conditions, warranties, rights and terms are excluded.

 

2. Where any condition, warranty or right is implied by law and cannot be excluded, we limit our liability for breach of, or other act contrary to, that implied condition, warranty or right, either as provided under section 68A of the Trade Practices Act 1974 (Cth) or, otherwise to the extent permitted by law.

Subject to the provisions of clause 7.1 and 7.2 and, and despite any implication arising from any other provisions of these Terms, we are not, and will not be, liable to you in contract, in tort (including negligence), under any statute (to the extent permitted by law) or otherwise for, or in respect of, any direct or indirect loss, costs or damages that you incur or are liable for in connection with your use of this Site, the Service or the Content, including but not limited to if caused by any computer virus including a virus passed from this Site to your computer or any third party computer, or loss of online connection to this Site, the Service or the Content, or interruption to access to this Site, the Service or the Content.

2. If any provision or part of these Terms is for any reason declared invalid or unenforceable, the validity of the remaining portion is not to be affected and the remaining portion is to remain in full effect as if these Terms had been drafted with the invalid or unenforceable portion eliminated.

3. These Terms record the entire agreement between you and us and supersede all previous negotiations, understandings, representations and agreements in relation to the subject matter of the Terms.

2. All transactions must be submitted through our online shopping cart and checkout! A tax invoice will be issued for all purchases.
